The procedure for contracting the service is carried out completely electronically via the website https://www.elgatambbotes.com/ having the same validity as the face-to-face signature of the same.

These general conditions of sale detailed below are the only ones applicable and replace any other condition or prior agreement, unless the parties expressly agree in writing to another type of agreement and this cancels or modifies these general conditions of sale.

The language used throughout the contracting procedure shall be Spanish and shall be the language that governs relations between the parties; the provision of information in any other language shall be considered conditional on the former; in the event of discrepancy, the Spanish version shall prevail over any other translation or adaptation.

2. Place an order

All you have to do is enter the section of the online shop you are interested in, view the item you want and add it to the shopping basket. Repeat this process as many times as you wish to buy. At the end of the purchase process you will see the payment options. Choose the one that suits you best and confirm your subscription. Once you confirm the payment you will receive a copy of the General Terms and Conditions at the email address you have provided.

Our customer service hours are Monday to Friday, from 10:30 am to 1:30 pm and from 5:00 pm to 8:00 pm. From now on, when we talk about working days, these are counted from Monday to Friday.

Once the order has been placed, you will receive it at the indicated address as soon as possible, unless the order is placed on a public holiday or weekend, in which case the period indicated will start to run from the first working day.

3. Product information

To make it easier for you to order, we pay great attention to the information on the characteristics of the services by means of descriptions, photographs and videos illustrating our products.

4. Prices

Prices are shown in euros (VAT included).

Shipping costs are not included. You can see the amount in the section "Shipping policy".

We reserve the right to change our prices at any time. However, we undertake to apply the rates in force on the website at the time the order is placed.

5. Protected payment

We offer you the following payment methods:

By credit or debit card: Visa, Visa Electron and Mastercard.
By bank transfer.

Payment will be charged at the time of order confirmation, provided that you have obtained prior authorisation from your bank or cashier. If the payment has not been authorised, your order cannot be taken into account.

6. Product availability

EL GAT AMB BOTES S.C.P. will immediately remove products that are no longer available from the website. However, if the products are not withdrawn at the right time, after the order has been recorded, we undertake to inform the customer within 15 days, indicating the new deadline by which he/she will receive the order. In this case, the customer will have the option of cancelling the order by refunding the amount paid by the same method of payment used to pay for the order. Alternatively, the customer may request an exchange of their order by telephone or email.

7. Delivery

EL GAT AMB BOTES S.C.P. undertakes to deliver the product in perfect condition to the address indicated by the customer on the order form. EL GAT AMB BOTES S.C.P. shall not be liable for any errors caused in the delivery when the delivery address entered by the customer in the order form does not correspond to reality or has been omitted. It is the customer's responsibility to provide all the details necessary for the correct dispatch of his package.

If delivery cannot be made within 6 weeks, the customer has the right to withdraw from the contract. The cancellation must be in writing.

8. Right of withdrawal

You have fourteen (14) calendar days from delivery to the address indicated by the customer (in accordance with the provisions of articles 68 and following of Royal Decree 1/2007 -as amended by Law 3/2014-) to inform us that you are exercising this right.

The exercise of this right will be made without penalty and without the need to indicate the reasons, although the customer will have to pay the direct cost of returning the order to EL GAT AMB BOTES S.C.P..

To formalise your right of withdrawal, you should contact EL GAT AMB BOTES S.C.P.at the address elgatambbotes@gmail.comby filling in the withdrawal form enclosed. (DOWNLOAD DOCUMENT) to these Terms of Service as APPENDIX 1, with APPENDIX 2 being a copy of your purchase receipt and/or invoice, or by sending a reliable communication in lieu thereof. Upon receipt of such communication, EL GAT AMB BOTES S.C.P. will indicate how to send the order to its facilities, which must be unused and with all its labels, packaging and, where appropriate, original documentation and accessories that came with it. The cost of the return shall be borne by the customer and must be made within fourteen (14) calendar days following the date on which the customer has informed EL GAT AMB BOTES S.C.P. of its decision to exercise withdrawal.

The refund of amounts paid will be carried out as soon as possible and, in any case, within fourteen (14) calendar days from the date on which the customer has informed of his decision to withdraw by means of a refund according to the method used to make the purchase.

7. Seller's right of withdrawal

The seller may withdraw from the contract in one of the following circumstances:

Written errors or calculated errors on our website.
If the products are not available within a foreseeable period of time.
If there is a well-founded suspicion that the customer will not fulfil his obligations properly.

8. Force majeure

In the event of force majeure which significantly impedes or renders impossible our obligations, we are entitled to postpone the performance of our obligations for the period during which the difficulties persist and we may extend the deadline to a new appropriate date. We also consider strikes, port closures and similar conditions that directly or indirectly affect us to be force majeure.

9. Safeguard clause

All clauses or terms of this contract must be interpreted independently and autonomously, and the rest of the stipulations shall not be affected in the event that one of them has been declared VOID by a final court ruling. The contracting parties agree to replace the clause or clauses affected by another or others that preserve the effects pursued by the parties.

10. Dispute Resolution

EL GAT AMB BOTES S.C.P. shall not be liable for the non-execution of these conditions in the event of force majeure, as defined by the Spanish courts and in the event of the customer's fault or an unforeseeable event by a person outside the contract.

For any dispute arising from the breach of the conditions of purchase and sale, both parties will expressly submit to the courts and tribunals of Sant Feliu de Guíxols (Girona), except as established in the consumer regulations, waiving their own jurisdiction if this should be otherwise.

EL GAT AMB BOTES S.C.P. cannot be held responsible for any consequences that may result from the improper use of the products sold on its website.
